MistaStream Terms of Service

1) Eligibility

The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.

2) The Service

MistaStream transforms the way you handle text. It enables you to extract and organize text from images or screenshots, supports batch processing and quick scans, and provides a history feature to record and revisit past scans.

Some features may process content on servers controlled by MistaStream when you choose to upload images or text for processing. You control whether to upload and generate content.

3) Accounts

You may need an account to use certain features.

• You agree to provide accurate account information (such as name/username/email where applicable) and keep it up to date.
• You are responsible for maintaining the confidentiality of your account and for activities under your account.
• You must notify us promptly of any unauthorized use of your account.

4) Your Content and Permissions

"Your Content" includes images, screenshots, text, and other materials you upload or submit to the Service, as well as extracted text outputs.

You retain ownership of Your Content. You grant MistaStream a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, and display Your Content only as necessary to operate and provide the Service, including generating the outputs you request and maintaining your scan history (as enabled by you).

You represent and warrant that you have all rights necessary to provide Your Content and that doing so does not violate any laws or third-party rights.

5) Acceptable Use

You agree not to:

• Use the Service for illegal, harmful, or abusive activities
• Upload content that you do not have rights to use
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service (including introducing malware)
• Reverse engineer, decompile, or attempt to derive source code from the Service except where such restrictions are prohibited by law
• Circumvent security measures, usage limits, or access controls

We may suspend or terminate access if we believe you have violated these Terms or to protect the Service and users.

6) Privacy

Our collection and use of personal information is described in our Privacy Policy. Please review it carefully. A copy is made available wherever you obtained these Terms.

7) Purchases, Subscriptions, and Billing (If Applicable)

If the Service offers paid features:

• Prices and features may change; we will follow applicable platform rules for notice and consent.
• Payments and refunds are handled through the app store provider (e.g., Apple) and subject to their terms.

8) Intellectual Property

The Service (including software, design, trademarks, and content provided by MistaStream) is owned by MistaStream or its licensors and is protected by applicable laws.

These Terms do not grant you any rights to use MistaStream trademarks or branding without our prior written consent.

9) Third-Party Services

The Service may interact with third-party services or links. We are not responsible for third-party content, policies, or practices. Your use of third-party services may be governed by their own terms.

10) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISTASTREAM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MistaStream does not guarantee that the Service will be uninterrupted, error-free, or that extracted text will be perfectly accurate. You are responsible for verifying outputs before relying on them.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISTASTREAM AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISTASTREAM'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $50 IF YOU PAID NOTHING.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12) Indemnification

You agree to indemnify and hold harmless MistaStream and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your Content
• Your violation of these Terms or applicable law

13) Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if necessary to protect the Service, users, or third parties.

Sections that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution).

14) Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new "Effective Date" when changes take effect. Your continued use of the Service after changes become effective means you accept the updated Terms, to the extent permitted by law.

These Terms are governed by the laws of the jurisdiction of our principal place of business, without regard to conflict of law rules.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, except where prohibited by law. Where required, you may have the right to bring claims in small claims court or to seek public injunctive relief. The arbitration will be conducted in the jurisdiction of our principal place of business under rules that permit a fair hearing, and the arbitrator's decision will be final and binding.

17) Apple App Store Additional Terms

If you use the Service on an Apple-branded product and obtained the Service from the Apple App Store:

• These Terms are between you and MistaStream, not Apple.
• Apple has no obligation to provide maintenance or support for the Service.
• In the event of any failure of the Service to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the Service; to the maximum extent permitted by law, Apple will have no other warranty obligation.
• Apple is not responsible for addressing claims relating to the Service, including product liability, legal or regulatory compliance, or consumer protection claims.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as a third-party beneficiary.
